PERGOLUX Voluntary Limited 10-Year Pergola Warranty
Effective Date: April 1, 2025
This warranty applies only to orders placed on or after April 1, 2025.
To benefit from the limited warranty, the original purchaser ("Customer") must complete the installation of our Pergolas by following the provided manual. The limited warranty applies from the installation date, subject to registration of the Pergola product as indicated under "Warranty Conditions" below.
The limited warranty is non-transferable and only extended to the Customer.
In all cases, the warranty is limited to the price paid for the product.
Structure (Aluminum Frame): 10- years warranty against structural defects, deformation, or corrosion under normal use conditions.
Electrical Components (e.g., motors, wiring, control systems): 2- years warranty against material and manufacturing defects.
Moving Parts (e.g., louvers, hinges, mechanisms): 2- years warranty against wear and tear not caused by improper use or extreme conditions.
Powder Coating/Paint Finish: 5- years warranty against peeling & cracking under normal weather conditions.

THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT(S) WILL BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP.
TO THE EXTENT NOT PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, ORAL, WRITTEN, STATUTORY, EXPRESS, OR IMPLIED. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY STATEMENT AND TO THE EXTENT NOT PROHIBITED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO PRODUCT REPLACEMENT, REPAIR, OR REFUND OF PURCHASE PRICE, AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.
PERGOLUX LLC, located at 407 Brookside Rd, Waterbury, CT 06708, United States, provides this limited warranty to the initial purchaser of products sold by PERGOLUX (hereinafter referred to as "Products").
The Customer must register the product within 6 months of delivery to activate the limited warranty by notifying warranty@PERGOLUXshop.com and attaching a copy of their proof of purchase, as well as confirming that they have built up the pergola according to the provided instructions.
The warranty becomes active once PERGOLUX acknowledges the registration via automated email. As this is an automated email, the email does not confirm that the pergola has been built correctly. The below mentioned “LIMITED WARRANTY EXCLUSIONS” still apply. The purchaser must notify PERGOLUX promptly of any claims within the warranty period. Failure to do so may result in the claim being denied.
To ensure that your Pergola is properly registered for warranty and to provide you with the best possible service, we require the following information during the registration process:
Installation Photos:
Please submit clear, high-quality photos of the Pergola installation. These should include key angles that show the overall structure, alignment, and assembly of the pergola. It should include pictures showing that the columns and beams are attached with all screws. It should include pictures showing that silicone has been used to seal the corner detail. The photos help us verify that the installation was done correctly according to our guidelines.
Foundation Details:
We ask that you provide information about the type of foundation you used for the installation. This may include:
- Type of foundation (e.g., concrete slab, gravel, etc.)
- Depth and width of the foundation
- Any specific considerations made for the foundation to ensure stability and durability.
These details are important to confirm that the pergola is supported adequately, which can affect its long-term performance and warranty coverage.
Overall Garden Photos:
To give us an understanding of the installation environment, please share wide-angle photos of the garden or outdoor space where the Pergola has been installed. This helps us assess whether the location is suitable and if any specific environmental factors could affect the pergola's performance.
This warranty does not cover damages or defects caused by:
- Improper installation (by customer or by mounting partner)
- Modifications or repairs performed by unauthorized third parties.
- Exceptional weather conditions exceeding the specified load limits.
- Mechanical damage caused by improper handling or transport by the customer.
- Damage due to force majeure, including, but not limited to: color changes caused by sun and salt, damage from smoke, fire, extreme climatic conditions such as deep frosts, lightning, hail, ground movement, flooding, overflow of any stream, as well as vandalism.
- Direct or indirect damage resulting from negligence, improper maintenance, or improper use of the product, including exposure to heat sources or unauthorized modifications.
- Damage due to improper storage.
Slight discoloration in the paint is to be expected, due to UV radiation. This is not covered under this warranty. - Damage caused when the pergola is installed on a concrete slab or other surface that experiences movement.
- Direct or indirect damage caused by the customer's structure on which the pergola has been installed.
- Installation of the pergola more than 6 months after the purchase date.
- Costs related to packaging, dismantling, storage, transport, and handling of the pergola are not covered under the warranty.
- PERGOLUX is not responsible for the deconstruction of a faulty pergola, the construction of a replacement pergola, or the reinstallation of any replacement parts. The customer is solely responsible for all deconstruction and construction work related to warranty claims.
- This warranty does not cover consequential or indirect damages, including but not limited to lost profits or loss of use.
The application of the limited warranty shall be suspended if the Customer or Reseller has outstanding financial obligations to PERGOLUX and will remain suspended until these obligations are fulfilled. Purchasing a replacement part does not extend the length of the original limited warranty.
Any claims under this limited warranty must be made in writing and sent via email to warranty@PERGOLUXshop.com within 30 days of discovering the defect. The written notification must include:
- Name and address of the Customer
- A detailed description of the defect
- Photos supporting the claim
- Date of installation
- Date the defect was discovered
- Address where the product is installed
- Name of the installer
- A copy of the purchase invoice
Motor-related issues:
- Video of defective product in use
- Video which shows that remote, control unit & motor are correctly paired
- Video that shows how LED on control unit reacts when controlling motor
- Batch number
LED-light related:
- Video of defective product in use
- Video which shows that remote, control unit and led lights are correctly paired
- Video that shows how LED on control unit reacts when controlling led lights
- Batch number
Remote related:
- Video of defective product in use

Control unit related

General defective electronics:
- Video of Defective Product in Use: Record a video showing the defect. Ensure the video clearly displays the problem to confirm whether it's a manufacturing defect or an installation/user error.
- Batch Number of Parts: Add the batch number to track any potential recurring issues with the batch.
Damage from use/wear:
- Product/Part Damage Photo/Video: Capture images or a video clearly showing the damage.
- Batch Number of Parts: Include the batch number for identifying if this issue is batch-specific.
Damage from weather:
- Damaged Parts Photo/Video: Provide visual evidence of weather-related damage, including pictures or videos of the installation area to verify if the product was installed correctly.
- Batch Number of Parts: Attach the batch number to track whether the damage is related to certain batches exposed to specific weather conditions.
PERGOLUX reserves the right to inspect the structure and product upon receiving a warranty claim. Repairs should not be performed before the Company's inspection. Any repairs or modifications made before inspection may void the limited warranty at PERGOLUX's sole discretion.
After inspection, if the Company determines that the limited warranty applies, the Company, at its sole discretion and expense, will either:
- Replace the product,
- Repair the product, or
- Refund the amount paid for the product.
In certain cases, PERGOLUX may determine that a replacement part is not required and that the issue can be resolved by the customer with guidance from our customer service team. In such instances, we may provide you with instructions to address the issue yourself. We require you to follow these instructions as part of the troubleshooting process. Please note that a replacement part or new product is not guaranteed to be shipped.
If a replacement product is shipped, it may happen that we send a newer model, as the original product may no longer be available. Due to continuous product development, the replacement product may have slight variations in dimensions or specifications. If this leads to compatibility issues with an existing foundation or other setup, PERGOLUX is not liable for any resulting costs or modifications required.
If a replacement product or part is shipped, this part will only be shipped to the shipping address of the original order of the customer.
If a replacement product or part is shipped, the original 10 year warranty time does not reset. The warranty registration date of the original pergola is what is being used for the warranty timeframe.
In the event of a faulty product or part, the customer is responsible for its proper disposal in accordance with local regulations. PERGOLUX will not arrange for the return or disposal of defective items unless explicitly agreed otherwise.
All warranty claims will be processed within 180 days of receipt.
The Customer must cover all labor costs for repairs conducted by PERGOLUX after one year following the installation date.
If a product is replaced and the same model is no longer available, PERGOLUX will replace it with a product of equal value to the original purchase.
If PERGOLUX discontinues operations in the United States, the warranty will no longer be valid, and no further claims can be made under its terms.
